These Terms of Service ("Terms") govern your access to and use of the DataQ AI website at godataq.com and related services (the "Service"), operated by Haris Mehmood (sole proprietor), trading as DataQ AI ("DataQ AI," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1. What the Service Does

DataQ AI helps motor carriers and drivers analyze roadside inspection violations and prepare a Request for Data Review ("RDR," commonly called a "DataQ") for submission to the FMCSA DataQs system. We analyze the violation, identify potentially applicable provisions of 49 CFR, provide a challengeability assessment, and generate a draft rebuttal and supporting evidence checklist.

2. No Legal Advice; Not a Law Firm

DataQ AI is not a law firm and does not provide legal advice or legal representation. The analysis, scores, citations, and draft documents we generate are informational tools to help you prepare your own submission. We are not your attorney, and no attorney-client relationship is created. For legal advice about your specific situation, consult a licensed attorney. You are responsible for reviewing all output and for the final content of anything you submit to FMCSA or any state agency.

3. No Guarantee of Outcome

Whether a challenge succeeds is decided by the reviewing state agency and FMCSA, not by us. We do not guarantee that any challenge will be accepted, that a violation will be removed, or that your CSA score will change. Our challengeability scores are estimates, and we will tell you when a violation is, in our assessment, not worth challenging.

4. Your Responsibilities

You represent that you are authorized to act on behalf of the carrier whose data you submit, that the information you provide is accurate and truthful, and that you will not submit false statements or fabricated evidence to FMCSA. You are solely responsible for verifying the accuracy of any analysis before relying on or submitting it.

5. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 and using the Service for business purposes.

6. Credits, Plans, and Payment

The Service uses a credit system. Each completed filing costs credits as described on the pricing page. Credits are sold in one-time packs or included in subscription plans. Payments are processed by our payment provider, which acts as merchant of record. Credits are non-transferable and have no cash value except as set out in the Refund Policy. Subscriptions renew automatically until cancelled.

7. Acceptable Use

You agree not to misuse the Service, including by reverse-engineering it, reselling output without authorization, uploading malware, infringing others' rights, or using it to submit knowingly false information to a government agency.

8. Intellectual Property

We retain all rights in the Service, software, and templates. You retain rights in the documents and data you upload. You grant us a limited license to process your uploads solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is." We are not liable for indirect, incidental, or consequential damages, or for any regulatory, enforcement, insurance, or financial consequence arising from a violation, a filing, or its outcome. Our total liability is limited to the amount you paid us in the 3 months before the claim.

10. Indemnity

You agree to indemnify Haris Mehmood, trading as DataQ AI, against claims arising from your submissions, your breach of these Terms, or your violation of law.

11. Termination

We may suspend or terminate accounts that violate these Terms. You may stop using the Service at any time; see the Refund Policy for unused credits.

12. Changes

We may update these Terms; material changes will be posted with a new "Last updated" date.

13. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws rules.
